Gun Violence Victims' Access To Judicial System

Post by BusaDave9 »

The federal government has the Protection of Lawful Commerce in Arms Act (PLCAA). I hear this often described as making the gun industry immune from lawsuits. Actually it only prevents frivolous lawsuits. You can still sue a gun manufacturer if their product is unsafe (fires without pulling the trigger) or firearms are sold to people that shouldn't own them etc etc.

In Colorado they are trying to overthrow PLCAA with SB23-168 Gun Violence Victims' Access To Judicial System. It looks like it will be signed into law. This bill, Gun Violence Victims' Access To Judicial System is also known as "The Jessi Redfield Ghawi Act". It is named after a woman who died in the 2012 Aurora theater shooting. It's a horrible killing of innocent lives but the parents tried to sue the manufacturer of the gun and the ammunition. It was thrown out of court and plaintiff had to pay court costs, as they should.

I think that's like suing the car manufacturer that made a car that a drunk driver used to crash into and kill people. And the ammo, to continue my analogy it's like suing the gas station where the driver filled up his car the day before he got drunk.

What do you guys think?
I think it's an attempt to sue the gun industry out of business. I think it's aggravating.

Of course it is. Any and every new gun regulation is about disarming the American people. They dont give two shits about the murders or anything else. They just want us unarmed.

Commiting murder is already illegal. They cant possible be stupid enough to pass a law saying you cant have this or that is going to be obeyed by criminal.

Here's the problem. Republicans oppose any and all infringements on the 2nd amendment. They have good intentions but with all this gun violence we have to choose our battles wisely.

Here are just 3 of the gun bills getting pushed through Colorado legislature this year:
Red Flag expansion
Minimum age to buy firearms
Lawsuit bill

I say we have to let them have one or 2 of these. Instead republicans tried to block all gun bills. And as the Denver Post put it "House Democrats dusted off a rarely used rule to accelerate votes and end what they described as stall tactics."

Do you think it should be made even easier for someone who is mad at you to have the .gov come take your guns from you?
I dont agree with this thinking at all. Which 1 or 2 would you like them to pass?

Do you think that people who are old enough to die for this country shouldnt be able to own a firearm to defend their family?

Do you think gun stores or gun manufacturers should be held accountable for what a criminal might do after he obtains a weapon legally?

Murder is already illegal. Why do you think making other things illegal will keep bad people from doing bad things?

I think there must be give and take. When Democrats are the majority they will take. If we give a little they might be able to fight on the more important points.

The place we should be firm about is the lawsuit issue. People can already sue a gun manufacturer for anything they did wrong. This bill allows them to sue when there was no wrong doing.

There is no problem with people in the military abusing firearms. Those people are under more control and discipline. There is a problem with civilians killing each other and a lot of those killings are by young men.

I also think we can give a little on the Red Flag laws. I was opposed to them at first but they seem to be enforced as planed. Sure they take the guns without due process but they almost always get them back in 2 weeks.

I dont disagree with you on your points necessarily but i still dont agree that any of those laws should pass. Once again, all of that is feel good shit so they can claim that they are doing "something". Not one single part of it will do anything to stop gun violence. Criminals dont obey laws.

Hell I'll say it. The vast majority of the Country has turned their backs on God and I Believe he has started to turn his back to this country.

If you are going to pull the God card, do it correctly please.
Or maybe God wants this violence to occur and us to solve it?
